Terms of Service

Effective [Effective date]

These terms are an agreement between you and [Company legal name] ("we", "us") for your use of Larkroot, a service for producing AI-generated videos, ads and virtual creators. By creating an account or using Larkroot you accept these terms and our Privacy Policy. If you use Larkroot for a company, you accept them on its behalf and confirm you are authorized to do so.

1. Eligibility and accounts

  • You must be at least 18 years old and able to enter a binding contract.
  • Keep your sign-in secure. You are responsible for activity in your account and workspaces, including by people you invite.
  • Give accurate account information and tell us at [legal@your-domain.com] if you suspect unauthorized access.

2. Credit and payment

  • Paid actions (video, images, voice and AI writing) are paid from prepaid credit in your workspace.
  • Before a paid action runs we show its estimated cost and ask you to approve a maximum. We reserve up to that amount, charge what the action actually costs, and return the rest to your balance.
  • AI generation is not always successful or to your taste. Credit used by a generation that completed is not returned because you dislike the result. If a generation fails on our side, unused reserved credit is returned.
  • Credit has no cash value, cannot be transferred between workspaces and is non-refundable except where required by law or stated at purchase. Prices may change; a price change never applies to an action you have already approved.

3. Your content

  • "Inputs" are what you provide (product details, links, scripts, images, recordings). "Outputs" are what Larkrootgenerates for you. As between you and us, you own your inputs and, to the extent the law allows, your outputs.
  • You give us a limited license to store, process and transmit your inputs and outputs only to run Larkroot for you, including sending them to the AI providers that produce your content. We do not use your content to train AI models.
  • You confirm you have the rights to your inputs. AI outputs may resemble content created for others and may not be protected by copyright in every country; we make no promise that an output is unique or registrable.

4. Real people: likeness and voice

  • Only upload a real person's face, body or voice if you are that person or hold their documented, informed consent to create and publish AI-generated content with it. We record the consent statement you make at upload, and may ask for proof.
  • Never use Larkroot to impersonate someone, to make a real person appear to say or endorse something they did not agree to, or to depict a real person in sexual, violent or humiliating content.
  • The creators in the Larkroot library are synthetic characters, not real people.

5. Advertising and disclosure

  • You are responsible for everything you publish, including that product claims are truthful and substantiated, and that ads follow the law and the rules of the platforms you post on.
  • Where the law or a platform requires it, disclose that content is advertising and that it is AI-generated or features a virtual creator. Do not present an AI creator as a real customer with a genuine personal experience of a product.

6. Acceptable use

You must not use Larkroot to create or distribute content that:

  • sexualizes minors or depicts anyone who appears to be a minor in a sexual or suggestive way;
  • is sexually explicit, or is hateful, harassing, threatening or promotes violence;
  • is deceptive: scams, fake reviews or testimonials, misleading health or financial claims, or political disinformation;
  • infringes intellectual property, privacy or publicity rights;
  • promotes illegal products or activity, or violates any law.

You also must not attempt to break, overload or reverse-engineer Larkroot, get around credit or safety limits, or resell access without our permission. AI providers may refuse requests that break their own policies.

7. Third-party services

Larkroot relies on third-party AI models and infrastructure. Available models, their quality and their prices can change, and a provider may be temporarily unavailable. Features that connect to other services (such as social platforms) are also subject to those services' terms.

8. Suspension and termination

You can stop using Larkroot at any time and ask us to delete your account. We may suspend or close accounts that break these terms, create legal risk, or are inactive for a long time, with notice where reasonable. If we close your account without cause, we will refund any unused purchased credit.

9. Disclaimers and liability

  • Larkroot is provided "as is". To the extent the law allows, we disclaim all warranties, including fitness for a particular purpose and that outputs will be accurate, lawful for your use, or achieve any marketing result.
  • To the extent the law allows, we are not liable for indirect, incidental or consequential damages or lost profits, and our total liability is limited to the amount you paid us in the 12 months before the claim.
  • You will defend and indemnify us against claims arising from your content, your ads or your breach of these terms, including claims by people whose likeness or voice you used.

10. Changes and general terms

We may update these terms. For material changes we will notify you by email or in the app before they take effect; continuing to use Larkroot afterwards means you accept them. These terms are governed by the laws of [State / country]. If a provision is unenforceable, the rest remains in effect.
